James B Scully sues AVM Biotechnology, Inc. for breach of contract

In the United States District Court for the Northern District of Illinois, James B. Scully has filed a lawsuit against AVM Biotechnology, Inc., Theresa Deisher, Daniel Spina, and Gerald McLean. The case, identified as 1:24-cv-03190, was filed on April 21, 2024.

Scully is represented by attorney James W. Corbett and alleges that he began working as AVM's Chief Financial Officer (CFO) under an Independent Contractor Agreement in September 2022. All his work for AVM was performed remotely from his home in Gurnee, Illinois. The defendants are all citizens of different states; hence the court has diversity jurisdiction as the amount in controversy exceeds $75,000.

The plaintiff alleges that his compensation agreements were violated by the defendants. Under these agreements, Scully was to be paid a standard fee of $180 per hour and additional fixed fees for specific months which were agreed upon through email correspondence with then-CEO Joe Luminiello.

Scully seeks judgment against the defendants for breaching their contractual obligations towards him. He is seeking damages equivalent to the amounts he claims were agreed upon but not paid by AVM Biotechnology Inc.
